WHEREAS, pursuant to the provisions of the 1970 Constitution of the State of Illinois (the "Constitution"), the Village of Woodridge, DuPage, Will and Cook Counties, Illinois (the "Village") is authorized to create special services areas in and for the Village; and,

 

              WHEREAS, special service areas are established by home rule units pursuant to Section 6 (1) of Article VII of the Constitution which provides:

 

              "The General Assembly may not deny or limit the power of home rule units… to levy or impose additional taxes upon areas within their boundaries in the manner provided by law for the provision of special services to those areas and for the payment of debt incurred in order to provide those special services."

 

and are established pursuant to the provisions of "AN ACT to provide the manner of levying or imposing taxes for the provision of special services to areas within the boundaries of home rule units and non-home rule municipalities and counties," approved September 21, 1973, as amended (the "Act"), and pursuant to the Revenue Act of 1939 of the State of Illinois, as amended; and,

 

              WHEREAS, pursuant to the authority cited hereinabove, the Mayor and Board of Trustees of the Village of Woodridge did, on or about August 8, 1989, pass Ordinance No. 89-37, being an Ordinance establishing Special Service Area Number One of the Village of Woodridge, and authorizing the imposition and levy of a tax at a rate not to exceed zero and 03/100ths Dollars ($0.03) per one hundred  dollars ($100) of the equalized assessed valuation of all taxable property within the area for the purpose of paying the cost of providing special services in and for such area; and,

 

              WHEREAS, on or about March 1, 2007, the Mayor and Board of Trustees of the Village of Woodridge passed Ordinance No. 2007-11, being an Ordinance enlarging Special Service Area Number One of the Village of Woodridge; and,

 

              WHEREAS, the Corporate Authorities of the Village of Woodridge heretofore passed Ordinance No. 2017-72 being an Ordinance adopting an annual budget for corporate purposes of the Village of Woodridge in lieu of an annual appropriation ordinance, including Special Service Area Number One, for the fiscal year beginning January 1, 2018, and ending December 31, 2018; and,

 

              WHEREAS, in addition to amounts budgeted, there are amounts necessary to defray additional expenses and liabilities for Special Service Area Number One.

 

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Woodridge, DuPage, Will and Cook Counties, Illinois, a home rule municipality in the exercise of its home rule authority, that:

 

              SECTION 1:              The provisions of the preambles hereinbefore set forth are hereby restated herein as though fully set forth.

 

              SECTION 2:              That the total amount budgeted and other amounts deemed necessary to defray all expenses of Village of Woodridge Special Service Area Number One for the purpose of stormwater control and maintenance of stormwater control structures - contingency fund for repair or replacements for the fiscal year commencing on the first day of January, 2018, and ending on the thirty-first day of December, 2018 has been ascertained to be $34,855.

 

              SECTION 3:              Taxes in the amount of $34,855, or as much thereof as may be authorized by law, to defray all expenses and liabilities associated with the provision of special services to Special Service Area Number One, be and the same are hereby levied against all taxable property within Special Service Area Number One for the fiscal year commencing on the first day of January, 2018, and ending on the thirty-first day of December 2018.  Such taxes shall be in addition to all other taxes permitted by law.

 

              SECTION 4:              The Village Clerk is hereby directed to certify the passage of this Ordinance and to file a certified copy of this Ordinance with the County Clerk of DuPage County, Illinois, as by statute in such case made and provided.

 

              SECTION 5:              This Ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law.
